Purpose

The terms and conditions (the "T&Cs") of the website ostadelahi inpractice.com (the "Site") apply to all users of the Site upon registration on the Site (the "User").

The purpose of the T&Cs is to define the conditions of access and use of the Site and the terms by which services are provided therein.

Every User must agree and respect the T&Cs, without any condition. Should a User not agree with all or part of the T&Cs, he/she shall not use the Site. The T&Cs constitute a contract between the Site and the User.

The objectives of the Site are set forth by the founders of the Site in the section “About”.

In the T&Cs, the term « Site » may refer to either the Site itself or the founders and / or managers of the Site subject to the context thereof.

Services

After creating a personal account ("User Account"), all services available on the Site are optional and can be used free of charge. These services include:

  • Access to practical exercises regarding the practice of ethics in everyday life
  • Access to all posts on the Site
  • Access to the history of practical exercise carried out by the User
  • Access to a notebook in which the User can write notes and personal experiences
  • Voluntarily submit his/her notes for publication on the Site or make suggestions of books/articles to the Site
  • Seek advise from close and extended friends when choosing practical exercises
  • Send a message to the Site via the « Contact » form
  • Vote for certain content, within the limit of one vote per IP address and content

 

In short,

The Site posts contents regarding the practice of ethics in everyday life and allows User to suggest written recommendations to the Site, such as personal experiences, books, articles or practical themes.

Registration and use of the Site

Anyone with standard internet connection and HTML5 compatible browser may have access to the Site. For registration purposes, Users may choose a username and a password. Users may change their password at any time via "My Profile" / "Change password" tab but may not be able to change their username. Users will also be required to answer three simple questions as safeguard measures. The choice of questions and answers is important for several reasons:

  • they are used to protect a User’s personal information against loss
  • they are known by the User only and are not stored on the servers of the Site
  • Users’ written notes in their User Account are coded and are not stored on the servers of the Website
Therefore, the answers to such questions are the only way for the User (i) to change his/her password in case he/she forgets it and (ii) to have permanent access to his/her coded notes. If the User loses both his/her password and the answers to those questions, the Site will be able to create a new password, but the User’s coded notes will be lost for the future.

 

Users agree to keep their password secret and not to disclose it in any form whatsoever. It is at the User's risk should they use their login and password via the Internet. It is up to the User to take all necessary steps to protect its data against any attack.

Upon registration on the Site, Users must provide a valid email address and agree that such address will be used by the Site for communication purposes between the Site and Users as well as for general monitoring of operations performed by Users on their User Account.

All costs associated with accessing the Site, whether material costs, software or Internet access costs, are borne by Users. Users are responsible for the functioning of their computer equipment as well as their Internet access.

Users acknowledge the limitations and constraints of the Internet and, as such, recognize the impossibility of a complete safety of data protection. The Site cannot be held liable for damages resulting from the exchange of any information, including that of Users’ username and / or password, through the Site.

According to certain recommendations from CNIL, the Site may contact a User if his/her User Account has been inactive for three months. In the absence of any response from the User within three months of such contact, the Site may close the User Account.

To use the Site, one must sign-in and create a personal account secured by a username, a password and coded answers to personal and simple questions.

Every User is bound to keep his/her password secret and recognizes the limitations and constraints of Internet and notably, the impossibility to grant absolute security regarding data processing.

Access to the Site

If a User does not comply with the T&Cs, the Site reserves the right to unilaterally refuse a User access to the Site, without prior notice, whether temporarily or permanently.

The Site does its best effort to ensure quality access to the Site. It reserves the right to terminate, suspend or change, without notice, access to all or part of the Site, for site maintenance or any other reasons. The interruption of the Site will not entitle any User to claim compensation.

The Site can not be held liable for the interruption or unavailability of the network or servers or any other event beyond its reasonable control which prevents or limits access to the Site. The Site will under no circumstances, within the limits of applicable law, be liable for damages whether direct or indirect, tangible or intangible, or of any nature whatsoever, arising out of the unavailability of the Site.

The Site does its best effort to ensure quality access to the Site and is not liable for the unavailability of the Site, within the limits of applicable law.

Contributions

Each User can provide written contributions or comments to the Site (a "Contribution"). The Site has the right, without prior notice to the User, to accept the contribution in its entirety or partially, or to reject it. Should a Contribution be accepted, it will be published in "To go further ..." tab and will be accessible to all Users.

Before posting a Contribution, the Site may also make some changes, mostly minor changes (corrections of syntax and form) without prior notice to the User, in order to ensure compliance with the Site editorial policy, and in particular to ensure the confidentiality of information reported in the Contributions. To this end, Users consent to transfer all their rights to the Site. Given that Contributions are intended to report factual events of a User or a third party, the Site recommends Users to hide the truth of certain facts or names in order to ensure compliance with privacy and protect the reputation of the individuals referred to therein.

Users may not use the Site in any manner which could damage or compromise the rights of the Site or of other Users. For each Contribution, the author represents to have all the necessary rights to grant the permissions referred to herein.

Users may suggest written Contributions which will be reviewed before posting to ensure compliance with the editorial rules of the Site and, as much as possible, with confidentiality and privacy.

All Users agree to use the Site in compliance with the law and not to cause any damage to the Site or to other Users. Users recognize that information available on the Site is personal and agree not to breach privacy and reputation of other Users.

Copyright - Use of Content

All content posted on the Site is protected by intellectual property rights or copyright as provided for under applicable law. Documents available on the Site with the prior consent of their author are covered by intellectual property rights belonging to such author. Users may reproduce such content with the prior written consent of the holder of intellectual property rights and represent that they have the right to share such material in their Contribution, or any other content. Any violation by a User of any applicable international law and convention is punishable by law.

Information available on the Site is protected by copyrights and cannot be used in breach of applicable law or without the prior consent of its author.

Processing of personal data

Personal data stored on the Site and visible to the Site only (not to other Users) are name, surname, city of residence, email address and IP address of:

  • any User who registers on the Site
  • any User who sends a message to the Site via the « Contact » form
  • any User who suggests a Contribution to the Site

 

The « Contact » form indicates in each case the fields that are mandatory or optional.

The name or username of a User will not be disclosed upon publication of a comment or Contribution on the Site. Each Contribution is entirely confidential and anonymous.

Similarly, e-mail addresses will not be disclosed and will be used exclusively for communication between the Site and a User. IP address will not be published and will only be used to prohibit access to the Site to any User violating the T&Cs or the law.

Data and personal information written by Users on their User Account (in their practical work, for example) and in general all content available of a User Account, remain confidential, even to the Site for three main reasons:

  • communication between the browser and the server is coded (256-bit SSL encryption protocol).
  • the content of Users’ personal notes is coded on their computer before being stored on the servers of the Site. It is therefore impossible for the Site to read these notes.
  • User Accounts are accessible with password only. Passwords being confidential (subject to the User not disclosing it) and coded in the database of the Site, the Site does not have any special or privileged access to the contents of any message written on a User Account.

 

Data are not available to the hosting company which is thus incapable of reading it or disclosing it to third parties.

In short,

The following data is accessible to the Site only: name, first name, email address and IP address of a User.

The following data is confidential and not accessible to the Site and other Users: username, data and personal information written by a User on his/her User Account.

Privacy

Due to the extension of new means of communication, one must pay specific attention to privacy. In order to ensure protection of Users’ privacy, the Site commits to collect and process personal data in compliance with the French Act on Data Processing, Data Files and Individual Liberties dated January 6th, 1978 (the “Act”).

Users and the Site commit to collect any personal information, use it and in general act in compliance with any rules regarding life privacy or reputation. They undertake not to commercialize information or documents available through the Site and not to disclose them to third parties except as provided by law. If any User uses data available on the Site in a way that infringes upon the reputation and privacy rights of any individual (including a User), and in general, is contrary to law, such behavior may lead to the deletion by the Site of the User account and such User could be liable to penalties under the law.

The Site does its best effort to maintain a high degree of confidentiality of personal data by using appropriate techniques. However, given that no mechanism offers total security, each User acknowledges that there will always be some element of risk when personal information is transmitted through the internet.

Pursuant to article 32 of the Act, data collected by the Site is intended for the Site only and for relationships between the Site and Users, to the exclusion of any third party, for purposes described above and in no way for commercial purposes, which the User accepts.

Moreover, in accordance with Articles 39 and seq. of the Act, the Site guarantees any User the right to access, rectify, oppose and delete data regarding such User:

  • directly on the site, in "My Profile" / "Edit profile" tab
  • by using the contact form

 

A message sent via the contact form should include contact information (name and email) similarly to those indicated upon registration. An audit will be conducted by the Site pursuant to an exchange of emails before proceeding to the User’s request as soon as possible.

In case of termination of a User Account, personal data relating to the User will be kept for a period not exceeding what is required by law.

The Site cares a lot about confidentiality. The Site does its best effort to ensure a high level of confidentiality. However, given that no mechanism ensures maximum security, every User recognizes that there may be some risk when using the internet to share personal data.

Every User can access, modify, reject and delete personal data related to him/her.

Connections

Each User recognizes that the Site is not responsible for, and disclaims any and all liability for the content of any site to which he/she may have access through the Site. The Site has no legal control over the content of such external sites and therefore can not be held responsible for the proper compliance of such sites.

The Site cannot guarantee the availability and safety of data from other sites that may be available on the Site.

Cookies

One or more cookies may be stored on Users’ computer when they visit the Site. Cookies do not identify a User. They record information about navigation habits on the Site (such as pages viewed, date and time of visit, etc..) which the Site can have access on subsequent visits.

The Site recommends Users to accept cookies in order to ensure confidentiality of information available on his/her User Account. However, if a User wishes to refuse cookies, it may do so in his/her browser through the appropriate setting/options tools.

Services available on the Site are provided on a "as is" "where is" basis without warranty of any kind, whether express, implied or legal. Accordingly, the Site is not responsible, for any reason whatsoever, for the use of information and content available on the Site, which Users recognize.

The Site does not make any representation as to the availability, security or reliability of functions, materials and contents available on the Site. The Site undertakes to do its best efforts to ensure that information available on the Site is accurate, updated and reliable, but does not guarantee that the quality of services and information available on the Site meet a User’s expectations.

In addition, information provided on the Site shall not in any way constitute any advice or recommendation of any kind. Information made available on the Site is for information purposes only. Any User is responsible for the appropriate use of the Site, with judgment and intelligence.

The Site will under no circumstances within the limits of applicable law, be liable for damages and / or injuries, whether direct or indirect, incidental, material or immaterial or of any kind whatsoever, for any reason whatsoever (or for any damage resulting from a misinterpretation of an article or a Contribution, misinformation or for defamation) arising out of or related to any use of the Site or the publication of any information on the Site. The term “use” should be interpreted in a broad sense, that is to say, any use of the Site whatsoever, lawful or not, including a Contribution made by a User, the accuracy, adequacy or reliability of contents or sources from which contents are made available on the Site, notwithstanding the fact that Contributions are reviewed by the Site prior to their publication for compliance purposes with the editorial policy of the Site. As such, the Site makes no representation as to the appropriate use for any reason whatsoever of any information contained in any Contributions.

Force majeure

Duration and validity of T&Cs

The T&Cs will remain in full force and effect for an indeterminate period of time from the day a User signs-in until he/she resigns from the Site.

The T&Cs are governed by French law. French courts have exclusive jurisdiction for any disputes that may arise between the parties regarding the enforcement or interpretation hereof, which could not be settled priory by mutual agreement. French law will govern any legal relationships between Users and the Site.

The Site reserves the right to change the T&Cs from time to time, to interrupt the service or change its concept without prior notice to the User. It is up to the User to regularly check the T&Cs as all Users are bound by any revisions. The use of the Site further to the effective date of such and such modifications constitutes the User’s acceptance to all such changes.

The T&Cs remain in full force and effect from the day a User signs-in until he/she resigns from the Site.
