II. Terms and Conditions of Use
The terms and conditions of Use (the “T&Cs”) of the website ostadelahi-inpractice.com (the “Site”) apply to all users of the Site upon registration on the Site (the “User”).
The purpose of the T&Cs is to define the conditions of access and use of the Site and the terms by which services are provided therein. Any access to and/or use of the Site implies unreserved acceptance of and compliance with all the T&Cs as well as the personal data protection policy and the cookie management policy described on the dedicated pages for yourself and, where applicable, for any minors in your care under 15 years of age.
Should a User not agree to all or part of the T&Cs, he/she shall not use the Site.
The objectives of the Site are set forth by the founders of the Site in the section About.
In the remainder of these T&Cs, the term Site may, depending on the context, refer either to the Site as such or to the founders and/or managers of the Site.
Services
After creating a personal account ("User Account"), all services available on the Site are optional and can be used free of charge. These services include:
- Access to practical exercises regarding the practice of ethics in everyday life
- Access to all posts on the Site
- Access to the history of practical exercises carried out by the User
- Access to a notebook in which the User can write notes and personal experiences
- Voluntarily submitting his/her notes for publication on the Site or making suggestions of books/articles to the Site
- Seeking advice from close and extended friends when choosing practical exercises
- Sending a message to the Site via the « Contact » form
- Voting for certain content, within the limit of one vote per IP address and content
Registration and use of the Site
Anyone with standard internet connection and an HTML5 compatible browser may have access to the Site. For registration purposes, Users may choose a username and a password. Users may change their password at any time via the "My Profile" / "Change password" tab but may not be able to change their username. Users will also be required to answer two simple questions as safeguard measures. The choice of questions and answers is important for several reasons:
- they are used to protect a User’s personal information against loss
- they are known by the User only and are not stored on the servers of the Site
- Users’ written notes in their User Account are coded and are not stored on the servers of the Website
Therefore, the answers to such questions are the only way for the User (i) to change his/her password in case he/she forgets it and (ii) to have permanent access to his/her coded notes. If the User loses both his/her password and the answers to those questions, the Site will be able to create a new password, but the User’s coded notes will be lost for the future.
Users agree to keep their password secret and not to disclose it in any form whatsoever. It is at the User's risk should they use their login and password via the Internet. In addition to the protective measures taken by the Site, it is the User’s responsibility to take all necessary measures to protect their data against any attack.
Upon registration on the Site, Users must provide a valid email address and agree that such address will be used by the Site for communication purposes between the Site and the User as well as for general monitoring of operations performed by Users on their User Account. For further information, see the Personal Data Protection Policy section.
All costs associated with accessing the Site, whether material costs, software or Internet access costs, are borne by the User. Users are responsible for the proper functioning of their computer equipment as well as their Internet access.
Users acknowledge the limitations and constraints of the Internet and, as such, recognize the impossibility of a complete safety of data protection. Unless otherwise provided for by law, the Site cannot be held liable for damages resulting from the exchange of any information, including that of Users’ username and / or password, through the Site.
According to certain recommendations from CNIL, the Site may contact a User if his/her User Account has been inactive for three years. In the absence of any response from the User within three months of such contact, the Site may close the User Account.
Access to the Site
If a User does not comply with the T&Cs, the Site reserves the right to unilaterally refuse a User access to the Site, without prior notice, whether temporarily or permanently.
The Site does its best effort to ensure quality access to the Site. It reserves the right to terminate, suspend or change, without notice, access to all or part of the Site, for site maintenance or any other reasons. The interruption of the Site will not entitle any User to claim compensation.
The Site cannot be held liable for the interruption or unavailability of the network or servers or any other event beyond its reasonable control which prevents or limits access to the Site. The Site will under no circumstances, within the limits of applicable law, be liable for damages whether direct or indirect, tangible or intangible, or of any nature whatsoever, arising out of the unavailability of the
Site.
Contributions
Each User can provide written contributions in the form of practical points (a "Contribution"). The Site has the right, without prior notice to the User, to accept the contribution in its entirety or partially, or to reject it. Should a Contribution be accepted, it will be published and become accessible to all Users.
Before posting a Contribution, the Site may also make some changes, mostly minor changes (corrections of syntax and form) without prior notice to the User, in order to ensure compliance with the Site editorial policy, and in particular to ensure the confidentiality of information reported in the Contributions. To this end, Users consent to transfer all their rights to the Site. Given that Contributions are intended to report factual events of a User or a third party, the Site recommends Users to hide the truth of certain facts or names in order to ensure compliance with privacy and protect the reputation of the individuals referred to therein.
Users may not use the Site in any manner which could damage or compromise the rights of the Site or of other Users. For each Contribution, the author represents to have all the necessary rights to grant the permissions referred to herein.
Copyright - Use of Content
All content posted on the Site is protected by intellectual property rights or copyright as provided for under applicable law. Documents available on the Site with the prior consent of their author are covered by intellectual property rights belonging to such author. Users may reproduce such content with the prior written consent of the holder of intellectual property rights and represent that they have the right to share such material in their Contribution, or any other content. Any violation by a User of any applicable international law and convention is punishable by law.
Connections
Any reference or connections with this Site on an external site must be approved in advance by a Site administrator via the contact form. Each User recognizes that the Site is not responsible for, and disclaims any and all liability for the content of any site to which he/she may have access through the Site. The Site has no legal control over the content of such external sites and therefore cannot be held responsible for the proper compliance of such sites.

Services available on the Site are provided on a "as is" "where is" basis without warranty of any kind, whether express, implied or legal. Accordingly, the Site is not responsible, for any reason whatsoever, for the use of information and content available on the Site, which Users recognize.

Duration and validity of T&Cs
The T&Cs will remain in full force and effect for an indeterminate period of time from the day a User signs in until he/she resigns from the Site. By browsing this site, each user accepts these general terms and conditions for himself/herself and for and on behalf of any minors under 15 years of age at his/her charge.
The T&Cs are governed by French law. French courts have exclusive jurisdiction for any disputes that may arise between the parties regarding the enforcement or interpretation hereof, which could not be settled priory by mutual agreement. French law will govern any legal relationships between Users and the Site.
The Site reserves the right to change the T&Cs from time to time, to interrupt the service or change its concept without prior notice to the User. It is up to the User to regularly check the T&Cs as all Users are bound by any revisions. The use of the Site further to the effective date of such and such modifications constitutes the User’s acceptance to all such changes.
